Just to ad to my previous entry here is the latest entry from Tony (Abbey). I will email him today stating the KZr forum being aware of the current situation so maybe I'll get some action. Again I'll add that they are not responsible for the previous JMC F#@%ups so please for now lets be gentle, I'll let you know how it went.

to me
Good morning John.
I’m sorry that you’ve had no feedback for a while and my only (very poor) excuse is pressure of work.
I passed the last few dimensions on to our production team as soon as you confirmed them and am still awaiting a reply from them.
The swingarm project is a very small part of our business and due to current shift patterns, I have been unable to actually speak to them since.
I understand that they will be back on days before the end of this week and I will be able to give you something more definite then.
I appreciate your patience.
Regards,
Tony.

Holy cow! What kind of laws are you guys stuck with? Here if someone buys out a business the new owner not only receives the business’s resources and accounts receivables but also is responsible for the business’s debt. Can you imagine the uproar if American Airlines after buying TWA told TWA ticket holders they were SOL? Assuming the new owners bought the rights to use the JMC brand they should be responsible for filling orders already placed or refunding the deposits. This sounds like a good case for litigation against the new or original JMC owners. Ed

Not sure about the laws in Australia but these guys are in the UK. You are right, in my opinion if a company name is bought out they should be responsible for all their debts, stinks doesn't it.
Worse still it appears the poor buggers in the UK aren't treated any better than I am in Australia.

To me it sounds as though Abbey bought out the remains of what was left of JMC. Not the Name, which would have made them responsible for all debts etc. With what they are probably going to do is offer a discount to the customers of JMC who were left hanging/ no product for their cash. While this may be less than what people would like, it may be the best that can be expected, when they really have no Legal Obligation to do anything. Might cost a lot by the time you pay twice. I've got several stories I could share where I've had to pay again for the service. The worst was a freight company that went into receivership while shipping all of my tools back from overseas. Cost me double, but I got my tools.

Motörhead you are spot-on about paying out more but it might be better
than losing my previous payments, it appears the poor bastards in the ZRX
forum are worse of then I am.
Funny (not) part was (in the ZRXforum) JMC also demanded extra money from
me before he went arse up, stating my swingarm was ready for delivery, all that was
required was the polishing, the problem was I ordered a black one???
Let's hope Abbey does the right thing by all.
I'll write back in a couple of weeks and let you know
Thanks again for all your support, unlike the poor bugger in the ZRX forum that
has to go to church to find sympathy and friends.

Hi Bozo,
For what its worth, I have a Metmachex shallow under braced aluminium swing arm that I no longer need as I recently acquired a K&J swing arm from Germany.
The Metmachex was previously fitted to a Suzuki GS1000 and with very little engineering will fit into a KZ. I'm afraid I dont have pictures of it and it is at home in Ireland at the moment. (I'm going home at Xmas) If you are interested in using this swing arm, give me a call back. Im in Toronto, Canada, 905-467-9041 Hope this may help you out. Cheers, Slash.

Slash, thankyou for your offer.
The reason I'm pursuing the JMC swingarm mob is to see if I can at least re-coup some of my loses that have been paid so far. I currently have a modified GPZ 750 turbo swingarm which is doing a great job.
Maybe another member will take you up on your offer, again, thankyou.

The latest on this saga is that Mike Roberts emailed me back (he has been a great help considering he works for the government) and supposedly Tony from Abbey will return my email with some news shortly, I'll keep you posted. I just hope its not JMC stalling of old.

Thanks for asking, I've been in touch with the Government rep and I was assured they would get back to me. I'M STILL WAITING.
I'm slowly giving up as the new mob don't appear to be better than the previous owner.
Is there anyone out there who has or knows of someone who has ordered a new swingarm from the new JMC ????

I too remember reading about somebody else having trouble getting their arm from JMC but I can't find the thread. There are other threads from people that have the arms now....maybe they could help with information on how they finally got theirs. Here are a couple of links to look at, maybe you've already seen them:
www.kzrider.com/forum/11-projects/557661...kz1000/post?do=quote (drooz mentions JMC is hard to deal with)
www.kzrider.com/forum/5-chassis/510751-j...new-ownership#511289
I'll keep looking for that other thread...somebody here has already gone through this.
